말레이시아의 이주노동자 탄압에 대한 긴급 항의문을 전하고자 합니다.
2005년 3월 1일 말레이시아의 정부는 불법노동자에 대한 사면기간을 끝내고 대규묘의 탄압을 시작하였습니다. 정부는 거의 50만에 달하는 관리, 경찰 민간인을 대규모 탄압을 위하여 투입하였습니다.  
말레이시아정부는 불법체류 외국인을 체포하는 시민에게는 미화21달러에 달하는 보상금을 지불하고 있으며 민간인이 체포영장 없이도 체포하고 총을 소유할 수 있는 권한을 주고 있습니다. 이를  "OPS TEGAS"라고 작전명을 붙였습니다.

2005년 3월 3일 말레이시아 출입국관리소는 로이터 통신에게 전국에 걸쳐 행한 28차례의 불시단속으로 131명의 노동자가 감금되었다고 전하였습니다. 이러한 탄압은 외국인노동자의 심각한 인권침해를 야기할 것입니다.

다음은 말레이시아 수상에게 보내는 항의문입니다.

AN URGENT APEAL TO THE MALAYSIAN GOVERNMENT TO STOP THE CRACKDOWN ON ILLEGAL MIGRANT WORKERS

Dear Prime Minister Datuk Seri Abdullah Ahmad Badawi,

We, the Migrant Forum in Asia, a network of 230 migrant organizations and advocates from 13 countries in Asia, are very much concerned by your government’s crackdown on illegal migrant workers in Malaysia. Hundreds and thousands of illegal migrant workers are fleeing the border or hiding from the 20,000 immigration officials, soldiers and police officers you have deployed for the crackdown.

Migrant workers come to Malaysia not only for the simple reason of augmenting their income and seeking better economic opportunities. A big number of migrant workers coming to Malaysia leave their home countries to escape armed conflict as well.

The United Nations Convention on the Protection of the Rights of Migrant Workers and members of their families state that migrant workers have the right to liberty and security of person; right to protection from cruel and inhuman punishment; right to legal personality and recognition as a person before the law; right to representation, consultation and protection from discrimination and exploitation. The crackdown on migrant workers negates all the above mentioned rights. As a member of the United Nations we would like to remind you of your commitment to protect the rights of migrant workers.

We are appalled by the Malaysian Government’s recruitment of more than 300,000 volunteers and the promise of cash rewards, 80 ringgit or US$ 21,  for each illegal migrant worker they can apprehend under the operation codenamed “OPS TEGAS” We are shocked that your Government has given these volunteers the right to carry guns and search properties without warrants. We believe that the deployment of almost 500,000 immigration officials, police officers and volunteers will lead to violence and the cruel treatment of migrant workers.

We the Migrant Forum in Asia are also concerned about the non-payment of wages of illegal migrant workers since the announcement of the crackdown. A big number of migrant workers who went home during the amnesty period were not given their salaries. Almost a hundred thousand Indonesian migrant workers who were not paid their wages are refusing to come home despite the crackdown.

The massive crackdown has resulted to human rights violations especially among women and children. As signatory to the UN Convention on the Elimination of all forms of Discrimination Against Women (CEDAW) and the Convention on Children’s Rights we would like to remind you of your commitment to uphold the rights and well being of women and children

Migrant workers form the backbone of Malaysia’s menial work force, sustaining the construction industry and plantations. Migrant workers also take on low paying jobs in restaurants and domestic work, jobs Malaysians won’t take. Amidst the massive human rights violations of migrant workers by the Malaysian Government, we, the Migrant Forum in Asia demand for the Malaysian government to:

·        Stop the Crackdown on illegal migrant workers;
·        Stop the deployment of civilians arresting illegal migrant workers;
·        Conduct an investigation of recruitment agencies deploying illegal migrant workers and taking advantage of undocumented migrant workers;
·        Develop a more humane immigration policy that adheres to international human rights standards and
·        Prosecute employers who refuse to pay the wages of migrant workers
